Mova User Terms & Conditions

Effective Date: The date you accept these Terms online.

1. Introduction

These User Terms & Conditions (“Terms”) govern your use of the Mova Made To Move (Pty) Ltd platform (“Mova”, “we”, “our”, “us”), registration number 2025/449997/07. By creating an account, you confirm that you are at least 18 years old, you have read and agree to these Terms, and you accept that updates to these Terms will require your renewed acceptance before further use.

2. Eligibility & Registration

• You must be 18 years or older to use Mova.
• You must provide accurate personal information and keep it up to date.
• You are responsible for maintaining the confidentiality of your account login details.

3. Subscription & Credits

• Your subscription provides a monthly allocation of credits to book classes with partner studios.
• Rollover: Unused credits roll over to the next month up to the number of credits in your new month’s plan. If your plan changes, the rollover cap is based on the new plan’s monthly credits.
• Credit Expiry: Credits expire immediately upon cancellation of your subscription.
• Credits are non-refundable and non-transferable.
• All payments are processed in ZAR through Paystack (credit/debit card), with buy-now-pay-later options to be added in future.

4. Bookings, Cancellations & No-Shows

• Booking window: You may book up to 14 days before a class; latest booking time varies per studio and may be as little as just before class start or up to 24 hours before.
• Cancellation: To avoid penalties, you must cancel before the booking window closes. If you cancel within the booking window, your credits will be returned and you will be charged R10 per credit for a late cancellation.
• No-Shows: If you fail to attend without cancellation, you will lose your credits and be charged R15 per credit for a no-show. We may waive this fee the first time, but in most cases credits will still be lost as we are liable for paying the studios.

5. Pausing & Cancelling Your Subscription

• Pausing: You may pause your subscription at any time; credits expire at the end of your subscription.
• Cancellation: You must cancel at least 72 hours before your renewal date to avoid renewal charges.
• There are no reactivation or cancellation fees.

6. Studio Participation & Waivers

• By booking through Mova, you agree to comply with all partner studio rules and policies.
• You acknowledge and accept the risks inherent in fitness and wellness activities, and you release Mova, its directors, partner studios, and their instructors from liability for injury, loss, or damage, except where prohibited by law.
• Mova vets partner studios but does not vet individual instructors.
• You may be required to sign a studio-specific waiver the first time you attend a class at that studio.

7. User Conduct

• You must comply with all studio rules and instructions.
• Treat staff and other users with respect.
• Do not damage studio property.
• Do not misuse the platform or attempt to disrupt bookings or services.

8. Data & Privacy (POPIA Notices)

• Mova processes your personal information in accordance with the Protection of Personal Information Act (POPIA).
• By creating an account, you consent to receiving marketing emails and SMS messages from Mova; you can opt out at any time.
• Booking data will be shared with partner studios only for the purpose of managing your booking; studios may not use this data for independent marketing.
• Mova uses third-party analytics tools (e.g., Google Analytics, Mixpanel) to improve the platform.
• You have the right to request access to, correction of, or deletion of your personal information by contacting us at [email protected].

9. Pricing & Changes

• We may change subscription prices with prior notice to you.
• Introductory offers and trial periods may be subject to special rules communicated at the time of offer.

10. Disputes, Governing Law & Arbitration

• These Terms are governed by the laws of the Republic of South Africa.
• Any dispute arising from or related to these Terms will first be resolved through good faith negotiation.
• If unresolved, the dispute will be referred to mediation, and if still unresolved, to binding arbitration in Cape Town under the rules of the Arbitration Foundation of Southern Africa (AFSA). Arbitration will be the exclusive means of resolving disputes, except for claims to recover unpaid amounts owed by you to Mova, which may be brought in a court of competent jurisdiction.
• Class Action Waiver: You agree to bring claims against Mova only in your individual capacity and not as part of a class, collective, or representative action.

11. General

• Mova may update these Terms from time to time; we will notify you and you must accept the new Terms before further use.
• If any provision is found invalid, the remaining Terms remain enforceable.
• Failure by Mova to enforce any provision is not a waiver of that provision.

12. Service Modifications

• Mova reserves the right to modify, suspend, or discontinue any aspect of the platform, including studio participation, class availability, and features, at any time without liability to you. We will provide notice of material changes where reasonably possible.
